TERMS AND CONDITIONS

Riding Wild facilitates healing journeys for women in nature, primarily through horse riding trips that are led by third party ride operators. These Terms and Conditions govern your use of Riding Wild, a 501(c)3 nonprofit organization and is registered in California (“Riding Wild,” “Company,” “We,” “Our”), and the participation in our trips as well as our website and any related software or services provided by us (the “Services”).

In these Booking Conditions, the terms “you” and “your” refer to all individuals named in the booking, including anyone who may be added or substituted later. The terms “we,” “us,” and “our” refer to ‘Riding Wild,’ acting as the agent for the operator,” “us,” and “our” means ‘Riding Wild’ acting as the agent of the operator. 

This document, together with our Privacy Policy and any other terms specifically referred to therein, constitute a legally binding agreement (the “Agreement”) between you and the Company in relation to your use of our Services.

ACCEPTANCE OF TERMS

Riding Wild facilitates healing journeys for women in nature, primarily through horse riding trips that are led by third party ride operators. These Terms and Conditions govern your use of Riding Wild, a 501(c)3 nonprofit organization and is registered in California (“Riding Wild,” “Company,” “We,” “Our”), and the participation in our trips as well as our website and any related software or services provided by us (the “Services”).

This document, together with our Privacy Policy and any other terms specifically referred to therein, constitute a legally binding agreement (the “Agreement”) between you and the Company in relation to your use of our Services.

OPERATOR & RIDING WILD’S ROLES

The following conditions apply in addition to the contract you enter with the ride operator. The delivery of your ride is the responsibility of the ride operator who is the third party to this Agreement with Riding Wild. We act as agent for the operator, and we have no liability in relation to your ride or for the acts or omissions of the operator or any suppliers connected with that booking. The operator will have their own terms and conditions that apply to your booking and we will make these available to you at the time of booking.  By booking a trip, you are agreeing to these terms and conditions.

In our capacity as agent, we do not enter into contract with you in respect of the provision of any arrangements without limitation including the ride, accommodation, transport, and catering. In the event that we do provide any of these arrangements, we will inform you.

Our responsibility to you as an agent and facilitator is to provide information about the riding arrangements as well as provide an additional mindfulness and wellness program. Riding Wild’s staff collaborates with ride operators to guide the group throughout the ride and facilitates breath-work, movement, yin yoga, and yoga nidra sessions.

WHEN ACTING AS THE ORGANIZING AGENT 

Riding Wild may operate as the organizing agent of certain trips and will notify you in your booking form/confirmation which third party operators we will use. When acting as an organizing agent, we defer to the third parties’ Terms and Conditions to schedule your accommodations, your ride or other services.  Riding Wild will not be held liable for any failures or error by the third party operator when we book on our participants’ behalf.

DISCLAIMER

Riding Wild, its staff, and content-providers are not licensed medical care providers, therapists, psychologists, or psychotherapists or other formally licensed healthcare professions, practitioners, or providers of any kind. Riding Wild does not render medical, psychological, or other professional advice or treatment, nor does it provide or prescribe any medical diagnosis, treatment, medication, or remedy.

The information available on this website and on our rides is for informational purposes only. It should not be considered healthcare advice, medical diagnosis, treatment, or prescriptions. This information does not promise benefits, claim cures, serve as a legal warranty, or guarantee results. It is not a substitute for professional advice from your physician or other healthcare providers, nor for any instructions found on product labels or packaging. You should not use this information for diagnosing or treating any health issues or for prescribing any medications or treatments. Before making any changes to your current medications, treatment, or care, starting a new diet or exercise program, or if you have or suspect you might have a health problem, please consult with a healthcare professional.

YOUR BOOKING

Access to the Services is only available to participants who have agreed to these Terms and Conditions by submitting your booking. To make a booking you must complete a booking form and submit a deposit binding yourself to the booking conditions here and the operator’s terms. Once payment is submitted you will receive a liability waiver. Upon completion of your liability waivers a contract will exist between you, Riding Wild, and the operator.

PAYMENT

A 50% deposit or full payment is required to confirm your booking. If you choose to pay a 50% deposit, the remaining balance must be paid within 90 days before departure. The only exception is if a custom payment plan is provided, which will be offered on a case-by-case basis. If you have a payment plan, the final payment will also be due 90 days before departure.

The remaining balance for your booking must be received by us at least 90 days before your departure date so that we can make the necessary payments to the operator. You will have a deadline that is 5 days before the 90 day deadline to pay your final payment. We allow a 3 day grace period to make your final payment. After the 3 days have past your will incur a $100 late fee if the payment has not been made. If the payment has not been made by the 5th day when the 90 day deadline is set we reserve the right to consider your booking canceled by you, acting on behalf of the operator. In this case, you will be responsible for paying any cancellation charges outlined in the applicable terms and conditions of the organizers or suppliers.

ALTERATIONS BY YOU

Should you wish to make any changes to your confirmed trip, you must notify us in writing by email. Whilst we will endeavor to assist, we cannot guarantee we will be able to meet any such requests. Any further costs incurred by the operator will be payable by you. 

CANCELLATION BY YOU

Cancellation Policy
If you need to cancel your trip after confirmation and payment, please notify us immediately via email. We will make every effort to find a replacement for your spot on the trip. If we successfully fill your spot, we will provide a full refund minus a $300 cancellation fee to cover administrative costs. However, if a replacement cannot be found, a refund will not be possible.

If your spot is replaced, the refund will be processed within 30 days of your cancellation notification.

Our cancellation policy is as follows:

•    More than 90 days before departure:
The full deposit will be refunded, less any applicable bank fees and a $300 cancellation fee per rider.

•    90 to 60 days before departure:
25% of the total booking amount will be forfeited, and the remainder will be refunded if your spot is filled.

•    59 days or less before departure:
100% of the total booking amount will be forfeited, as it may not be possible to fill your spot on short notice.

•     If you need to cancel, you might recover cancellation charges through your travel insurance policy, depending on the reason. You must first pay the cancellation charges and then request a refund from your insurance company.

If any member of your group is unable to travel, they may be able to transfer their spot to someone else, as long as we receive at least seven days' notice before the departure date. The new rider must meet all the same requirements as the original rider, including riding ability and fitness. The you or the group leader will be responsible for completing the booking forms for the new rider.

CANCELLATION OR ALTERATIONS BY THE OPERATOR

It is rare that an operator may need to change or cancel a booking. Where an insignificant change is made such as changing the start date by less than a week, we will inform you of the new details and no refunds will be provided. If a larger change is required, the operator may offer alternative reservations. If you do not wish to accept these changes, you will be entitled to a full refund, as long as the changes are not a result of circumstances outside of Riding Wild or the operator’s control, such as weather changes or major operational difficulties.

INSURANCE

To participate in our trips, you must have an insurance policy for personal liability and medical and travel cancellation to be valid from the date when the contract with the operator comes into existence until the ride is completed. We recommend that you itemize the value of your ride by day with your insurer to ensure you receive the full amount of any potential return. When obtaining travel insurance, you must ensure that the insurer is aware of the type and destination of travel and any activities which you plan to undertake. Horse riding trips can be considered high risk and may not be included in the standard terms of your current travel insurance. 

Please provide us with a copy of your insurance information for our records. We may need to reference this if you are involved in an accident. If you do not arrange the required coverage, the operator reserves the right to refuse your booking or cancel your ride. In any case, neither the operator nor Riding Wild will be held responsible for any expenses, losses, or damages you incur due to your failure to comply with this requirement or the conditions of your travel insurance policy. Please read your policy details carefully and bring them with you on your ride. If you do not provide proof of insurance, we will not be liable for any losses you incur as a result of not meeting this insurance requirement.

SPECIAL REQUESTS AND MEDICAL CONDITIONS

Please be aware that horse riding trips in remote locations can be risky. Before booking a trip, ensure that your fitness level is sufficient to participate. We are not medical professionals and cannot assess your health or fitness to join our trips.

If you have any health issues or special requests, please inform us at the time of booking. We will do our best to accommodate but cannot guarantee that we will do so.  We reserve the right to cancel a booking if we cannot accommodate a health issue or special request at our sole discretion.

HARMFUL BEHAVIOR

Harmful behavior can include manipulation attempts, bullying, rudeness, passive/active aggression, unstable emotional behavior, and lying. We consider this type of behavior detrimental during group rides, especially when resilience is necessary for these physically demanding trips. Our duty of care is to the entire group, not just to an individual. If you engage in harmful behavior prior to a ride, we reserve the right to refuse your service. In this case, our standard booking cancellation terms will apply, and you may not be entitled to a refund. During a ride, harmful behavior that affects the enjoyment of other guests may also result in a refusal of service. This includes, but is not limited to, bullying other guests, Riding Wild facilitators, or guides; failing to follow safety instructions from the guide; and not being ready to start your ride promptly. It is the responsibility of the Riding Wild facilitators and guides to determine whether you can continue the ride, and we fully support their decision. There are no refunds for refusal of service based on these grounds, and you will need to make arrangements to leave your ride early if necessary.

FORCE MAJEURE

In the case that there are events outside of our control that prevent or significantly affect the providing of our Services, including but not limited to war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events, we may be forced to reschedule or cancel a trip. If the trip is cancelled due to an extraordinary circumstance, Riding Wild will have no liability for any expenses or losses due to the cancellation.

LIMITATION OF LIABILITY 

Riding Wild is a facilitator of the trips, but we are not responsible for the general operations or arrangements of the actual trips, which are led by third party operators.  We therefore accept no liability for issues related to the trip operations including but not limited to the horseback rides, transportation, accommodations, damage to baggage or personal items, food and water. The operator will be solely liability for any acts or omissions that cause harm during a trip. Please review the terms and conditions of the operator for more details regarding their responsibilities.  

THE COMPANY’S AND ITS SUBSIDIARIES, AFFILIATES, SUCCESSORS, AND ASSIGNS, AND THEIR RESPECTIVE EMPLOYEES, AGENTS, DIRECTORS, OFFICERS AND SHAREHOLDERS, LIABILITY TO YOU IS LIMITED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, LOSS OF GOODWILL OR BUSINESS REPUTATION, ANY COST TO PROCURE SUBSTITUTE GOODS OR SERVICES, OR ANY INTANGIBLE LOSS, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE WEBSITE, OR ANY OTHER SERVICES PROVIDED TO YOU BY THE COMPANY.

 

This limitation shall apply regardless of whether the damages arise out of breach of contract, tort, any form of error, or breakdown in the function of the service, or any other legal theory or form of action.

In the event that we are found liable on any basis whatsoever our maximum liability to you if we are found to have been at fault in relation to any service we provide as agent for the operator concerned, as opposed to any service provided by the third party for whom we are not responsible, is limited to the profit we earn or are due to earn in respect of the booking in question. We do not exclude or limit any liability for death or personal injury which arises as a result of our negligence or that of our employees whilst acting in the course of their employment. We will not be liable in any circumstances for any indirect or consequential loss or damage or for any sum which relates to or arises from any business including without limitation, self-employed loss of earnings. We will not be responsible for any lost or damaged baggage or personal items.

Horse riding is an inherently dangerous activity that can result in serious injury or even death. You are responsible for your own safety at all times. The operator may give you specific instructions for dealing with horses and the environment and you must always follow their guidance. The operator retains the right to deny you the opportunity to ride or be around the horses if they feel it is unsafe or that you have misrepresented your horse-riding ability. The operator does not owe you any compensation in this situation as you are responsible for sharing accurate information about your fitness and ability when booking so that the operator is able to accurately assess that their ride is appropriate for each rider. The ride operator may ask you to sign a disclaimer or waiver acknowledging that the ride operator is not responsible in the event of your suffering personal injury, death or damage to property. After completing your deposit, you will need to sign a Riding Wild liability waiver to finalize your booking. Whether or not you are asked to sign a disclaimer or waiver by the operator, neither the ride operators nor Riding Wild will be liable in the event you suffer personal injury, death or damage to property because of or in connection with horse riding or any horse related activity or which is otherwise caused by a horse or horses or any other animal.

PASSPORTS VISA AND TRAVEL REQUIREMENTS 

We will provide general information about passport, health and visa requirements applicable to your ride destination. However, you must pay all costs incurred in obtaining such documentation. You are solely responsible for obtaining accurate and up to date travel documents before departure. Riding Wild will not accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry all required documentation or otherwise comply with any passport, visa, or immigration requirements.

PHOTOGRAPHY AND TESTIMONIALS 

By participating in our trip, you acknowledge that we may collect photographs and videos, and you may provide written testimonials about your experiences. Unless you explicitly inform us in writing otherwise, you permit Riding Wild to use these materials for marketing purposes. This may include, but is not limited to, use on our website and social media accounts, and may involve your name, image, and likeness.

COMPLAINTS AND PROBLEMS

In the unlikely event you have a complaint regarding your ride, please inform the operator as soon as possible so that they can address the issue. If you are still dissatisfied, you may write to us at journeys@riding-wild.org and we will do our best to assist you. However, please note that your contract and responsibility for resolution remain with the operator, unless your complaint is directly related to our services and program.

APPLICABLE LAW

If a dispute arises between you and Riding Wild, we encourage you to contact us first to resolve the issue directly. You may contact us regarding any complaints or disputes at journeys@riding-wild.org.
 

These Terms and Conditions are construed in accordance with and governed by the laws of the United States, the State of California, and the county of San Francisco without reference to their rules regarding conflicts of law. 

TERMINATIONS

You agree that Riding Wild may terminate your booking at any time for your violation of any of the provisions of these Terms at our sole discretion. If we terminate your booking, we reserve the right to not provide a refund at our sole discretion. If you are dissatisfied with the Riding Wild Services, please let us know by contacting us at journeys@riding-wild.org. Your only other remedy with respect to any dissatisfaction with (a) the Services, (b) any portion of these Terms, (c) any policy or practice of Riding Wild in providing the Services, or (d) any content or information transmitted through the Services, is to terminate the Services and your booking. You may terminate the Services at any time by discontinuing your use of any and all parts of our Services and providing Riding Wild notice of termination by contacting us at journeys@riding-wild.org.

COMPLETE AGREEMENT

These Terms constitute the entire agreement between you and Riding Wild with respect to the use of our Services. Your use of the Riding Wild Services is also subject to the Riding Wild Privacy Policy. If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. No waiver of any of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
